These Terms of Use (“Terms”) govern access to and use of Haajri’s websites, mobile apps, kiosks, dashboards and related services (together, the “Services”) provided by Haajri (“we”, “us”, “our”). By creating an account, signing an order or quotation, or using the Services, you agree to these Terms. If you use the Services on behalf of an organisation, you confirm that you are authorised to accept these Terms for it, and “you” refers to that organisation (the “Customer”).
The Services
Haajri provides workforce attendance, shift and leave management, contractor and site management, compliance and payroll-ready reporting, and identity verification tools for employers and contracting agencies. Features, limits and pricing for your organisation are set out in your order, quotation or plan (the “Order”). Where an Order and these Terms differ, the Order prevails.
Accounts & Login Credentials
- Login credentials are issued to the Customer’s authorised administrators and users. Keep them confidential; you are responsible for activity under your accounts.
- Administrators decide who in the organisation gets access and with what role, and must remove access for people who leave.
- Tell us promptly at Dashrat@haajri.in if you suspect unauthorised access.
- Trial or demo access may be limited in time or features and may be ended at any time.
Customer Responsibilities
- Use the Services in line with applicable law, including labour, wage, social-security and data-protection law (such as the Digital Personal Data Protection Act, 2023).
- For your workers and staff, you are the data controller (data fiduciary): you decide what is collected and why, give the notices and obtain the consents the law requires (including for facial verification and location at punch-in/out), and handle their requests. Haajri processes this data on your instructions as described in our Privacy Policy.
- Make sure the data you enter is accurate and that you have the right to share it with us.
- Payroll, statutory filings and employment decisions remain your responsibility; reports from the Services support them but do not replace your own review.
Acceptable Use
You must not, and must not allow others to:
- access the Services without authorisation, share accounts, or bypass security, rate limits or usage limits;
- upload unlawful, infringing or malicious content, or use the Services to harass, track or monitor people beyond what the law and your workforce policies permit;
- copy, resell, reverse engineer or build a competing product from the Services, except where the law expressly allows it;
- interfere with the Services or other customers’ use of them, or test their security without our written permission.
Fees & Payment
Fees, billing periods and payment terms are set out in your Order. Unless stated otherwise, fees exclude GST and other applicable taxes, which are added to invoices. If an invoice remains unpaid after a reminder, we may suspend the Services after giving you notice. Fees paid are non-refundable except where your Order or applicable law says otherwise.
Your Data
You own the data you and your users put into the Services (“Customer Data”). You give us the right to host, process and display Customer Data only to provide, secure and support the Services, and as described in our Privacy Policy and Cookies Policy. We may use aggregated, de-identified data that does not identify you or any person to operate and improve the Services. On request at the end of your subscription, we will help you export Customer Data and will then delete it within a reasonable period, except where we must keep it by law.
Intellectual Property
The Services, including software, apps, designs, documentation and the Haajri name and logos, are owned by Haajri or its licensors and are protected by law. We give you a limited, non-exclusive, non-transferable right to use the Services during your subscription for your internal business purposes. Feedback you send may be used by us to improve the Services without obligation to you.
Third-Party Services & Integrations
The Services may connect to third-party products you choose, such as HRMS, ERP, payroll, messaging or identity tools. Your use of those products is governed by their own terms, and we are not responsible for them or for data once it leaves the Services at your instruction.
Availability & Support
We work to keep the Services available and secure, and we may carry out maintenance, updates and improvements. Support is provided through the channels and hours stated in your Order or on our Support page.
Confidentiality
Each party will keep the other’s non-public business information confidential, use it only for the purposes of these Terms, and protect it with at least reasonable care, except where disclosure is required by law.
Disclaimers
Except as expressly stated in these Terms or your Order, the Services are provided “as is” and “as available”. Facial verification, geofencing and automated rules reduce errors and fraud but cannot guarantee that every record is correct; you remain responsible for reviewing outcomes before relying on them for pay or disciplinary decisions.
Limitation of Liability
To the extent permitted by law, neither party is liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue or goodwill. Haajri’s total liability arising out of or relating to the Services is limited to the fees you paid for the Services in the twelve (12) months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
Indemnity
You will defend and indemnify Haajri against third-party claims arising from Customer Data, your use of the Services in breach of these Terms or applicable law, or your failure to give required notices or obtain required consents from your workers.
Suspension & Termination
Either party may end the subscription as set out in the Order. We may suspend or end access if these Terms are seriously breached, fees remain unpaid after notice, or suspension is needed to protect the Services or other customers. On termination, your right to use the Services ends, and the sections on fees owed, your data, intellectual property, confidentiality, disclaimers, limitation of liability, indemnity and governing law continue to apply.
Governing Law & Disputes
These Terms are governed by the laws of India. The parties will first try to resolve any dispute in good faith through discussion. Subject to that, the courts at Mumbai, Maharashtra have exclusive jurisdiction.
